Alleged Cocaine Deal: Court Rejects Abba Kyari, Other's Plea To Dismiss Charge Against Them

A Federal High Court in Abuja has dismissed the application filed by the suspended DCP Abba kyari and three other co-defendants asking to void the charge against them.


Justice Emeka Nwite, in a ruling, held that the court had the exclusive right and jurisdiction to hear drug-related cases as enshrined in the constitution of the Federal Republic of Nigeria and the NDLEA Act.

Recall on the 18 of Jan. Justice Nwite adjourned for ruling in the application filed by kyari and, other co-defendants in the suit bordering on drug offenses.

Kyari insists that the National Drug Law Enforcement Agency (NDLEA), should have allowed their employer, the Nigeria Police Force (NPF), to exhaust its internal disciplinary measures before taking them to the regular court. He said the charge against them was premature.

Kyari and others were charged with conspiracy to deal in 17.55kg of cocaine; dealing in cocaine without lawful authority; conspiracy to tamper with cocaine and unlawfully tampering with the 21.35kg of cocaine seized from two drug dealers.

The former IRT boss was also charged with an attempt to obstruct NDLEA officials in the conduct of their activities by offering them bribes.

The other applicants are ACP Sunday Ubia, Inspector Simon Agirigba, and Inspector John Nuhu.
