The Osun state Governor, Adegboyega Oyetola, has appealed against the judgement of the state Governorship Election Petition Tribunal which declared Adeleke of the Peoples Democratic Party (PDP) as the valid winner of the election that was held in September, 2018.
The three-man tribunal had, on March 22, 2019 in a slit judgement of two-to-one declared Adeleke and PDP the winner of the election.
The tribunal also nullified the certificate of return that was issued to Oyetola by the INEC and direct a fresh one be issued to Adeleke.
Justice Ibrahim Sirajo, the tribunal’s chairman, in his minority judgment, disagree from the majority judgment adopted by Justices Peter Obiorah and Adegboye Gbolagunte.
However, in his 39-ground notice of appeal filed on March 26, 2019, Oyetola urged the Court of Appeal to void the majority judgment which, he described, as wicked, packed with contradictions and not supported by evidence led by the petitioners.
Meanwhile, Chief Wole Olanipekun (SAN), The appellant lead counsel, who filed the notice of appeal on his behalf, prayed the Court of Appeal to uphold his appeal, and not only set aside the tribunal’s majority judgment but to also dismiss in totality the October 16, 2018 petition filed by PDP and Adeleke.
