A High court sitting in Abuja, Federal Capital Territory (FCT) has nullified the candidacy of Senator Ademola Adeleke, as a flag bearer of the Peoples Democratic Party (PDP) in the September 2018 gubernatorial election.
The court ruling, as presided over by Othman Musa, made the decision after it ruled that Adeleke failed to prove in court that he graduated from secondary school, as required by section 177 of the Nigerian constitution.
Mr, Adeleke had contested election against other candidates, including the All Progressive Congress (APC), Adegboga Oyetola.
The Independent National Electoral Commission (INEC), declared Oyetola of the APC the winner of the poll in a re-run election that was conducted in some part of the state on September 27.
However, on March 22, state election tribunal disqualified Oyetola’s victory on the ground that the re-run was illegal and gave the mandate to Adeleke.
Mr, Oyetola is challenging the decision in an Appeal court.
Meanwhile, the FCT High court disclosed Mr, Adeleke submitted a fake document for his West African Examination Council (WAEC).
The court also said Mr. Adeleke has failed to prove that he graduated from the Muslim High School, Ede, Osun State, as he falsely claimed since information about him was not contained in the school’s list of documents after 1980.
Mr. Adeleke informed the court through his lawyers that he was admitted into the school in 1976 and graduated after writing his WAEC exams in 1981.
As the court demanded, Mr. Adeleke had also provided a list of students who per took in that year’s WAEC exams and his results obtained from the said examination.
However, in the judgment, the court said the WAEC results tendered by Mr. Adeleke differ from those brought by the school.
The court added that Mr. Adeleke’s name only appeared only among the list of students who took part in the English Language examination for that year.
Consequently, the court ruled Mr, Adeleke has failed to prove he has fulfilled the requirement to participate in the election.
