The three hundred million naira suit against the Inspector General of Police by Suspected Kidnapper, Chukwudumeme Onwuamadike popularly known as ‘Evans’ before the Lagos State Federal High Court has been adjourned till Sept 21. The sitting vacation Judge, Justice Chuka Obiozor of the Federal High Court, Lagos adjourned the matter after holding that there was no more urgency for the suit to be heard during the vacation.
In the suit, the suspected Kidnapper, Evans, challenged his continued detention since June 10 without arraignment.
However, on August, 30, Evans and five others were arraigned before Justice Hakeem Oshodi of Lagos State High Court, Ikeja , on a two count charge of conspiracy and Kidnapping of one Dunu Donatus.
The Judge held that the arraignment of Evans and other before the State High Court last week has mitigated the urgency in the suit.
A day before the arraignment, the then vacation Justice Abdulazeez Anka had failed to deliver judgment in the N300m Fundamental Rights Enforcement Suit.
Justice Anka had to adjourn till today, September 5, at the instance of the Commissioner of Police Legal, Mr David Igbodo who turned up in court with an application claiming that the Inspector General of Police and the Nigerian Police Force had not been party to the proceedings and the court could not go ahead with judgment without hearing from both parties.
