The Senate has resolved to write the Chief Justice of the Federation, Justice Walter Onnoghen, to express their reservations about the judgment by a Federal High Court stopping the National Assembly from overriding President Muhammadu Buhari’s veto on the amended Electoral Act.

The Minority Leader, Senator Godswill Akpabio, moved a motion at the plenary on Thursday to state that the judgment amounted to “an abuse of the principle of separation of powers.”

 

He prayed that the Senate writes the CJN on the matter, which was unanimously granted.

 

Vigil360 had reported that a Federal High Court sitting in Abuja, ordered all parties in a suit brought against the National Assembly, Attorney General of the Federation, and the Independent Electoral Commission (INEC) by the Accord Party.

 

The Accord party had approached the court with a motion seeking an order of interlocutory injunction restraining the National Assembly from taking any further action or actions on the Bill titled Electoral Act (Amendment) Bill, 2018, particularly, to convene to pass the said Bill into Law, by two-thirds majority of its two chambers, pending the final determination of the substantive originating summon.

 

The court ordered all parties in the suit to maintain status quo ante bellum, at least till the next adjourned date.

 

Irked by the development, the Senate viewed the court’s order as an affront on the powers of the senate to carry out its constitutionally guaranteed rights.
