The Appeal Court on Thursday dismissed an appeal filed by Senator George Sekibo of the PDP challenging the judgment of the Rivers State National Election Tribunal which removed him as Senator representing Rivers East Senatorial District.

The Appellate Court held that the appeal lacked merit as it did not show facts as to why the decision of the lower court should be set aside.

The three-man panel of the Appeal Court held that the ousted lawmaker only reproduced his closing remarks at the end of the hearing at the tribunal, but did not challenge the decision reached by the tribunal.

The panel also held that according to the law, where an issue has not challenged the court has no business considering it.

The Rivers State Election Petition Tribunal had in June, ordered that Andrew Uchendu of the APC be sworn in as the winner of the senatorial election. According to the tribunal, Uchendu won the lawful majority vote cast during the Rivers re-run legislative election.

Although Senator Sekibo is yet to react to the latest ruling by the Appeal Court, he is most likely to challenge the ruling at the Supreme Court as he has previously claimed electorates voted “overwhelmingly for the PDP” in the State.
