As against the order of the Federal High Court, the Federal Government could not parade Mazi Nnamdi Kanu in court for his continued trial, making the court adjoin trial until October 21st, 2021.
Counsel to the Federal Government, Mohammed Abubakar stated this while lamenting that the secret police could not parade Nnamdi Kanu in court on time as required by the court for his continued trail stalling the trail for another day.
Although he stated that the Secret police could not produce the IPOB leader in court for Logistic reasons.
However, counsel to the IPOB leader, Ifeanyi Ejiofor, was visibly ranting and kicking in court blaming the Federal Government for deliberately frustrating the case.
Ejiofor made a frantic effort to move an application for the transfer of his client to Prison as a better option to the SSS detention facility instead.
However, his plea was rescinded when the court ordered that the IPOB leader should remain at the DSS detention facility in the meantime.
The trial Judge, Justice Binta Nyako insisted not to proceed until the Nnamdi Kanu is physically present in the courtroom as required by the law.
Moreso, the Judge added that despite Kanu’s absence, she informed the Federal Government lawyer that the yearly vocation of courts has commenced.
Nyako told both parties that Chief Judge of the Federal High court, Justice John Tsoho has directed for the trial to go ahead during vocation.
Nyako disclosed that it was the duty of the defense counsel to apply for the fiat during the vocation to continue but not the duty of the court to pronounce.
Although the Judge expressed reservation on the failure to bring Kanu to court, the matter was eventually fixed for October 21.
She gave a warning that the court will reconvene in an earlier date if the Chief Judge grants fiat for trial to proceed.
Nyako also directed that henceforth, only five lawyers would be allowed to stand in for Nnamdi Kanu’s case in line with COVID-19 protocol.
