Idris Okuneye, popularly known as Bobrisky, a controversial cross-dresser, has filed a notice of appeal on Monday to challenge the maximum six-month sentence given to him by a Federal High Court in Lagos. Bobrisky, who was convicted of currency mutilation and abuse of the naira, currency mutilation and abuse of the naira, is urging the appellate court to set aside the sentence and release him.
According to the appeal, filed by his lawyer, Bimbo Kusanu, argues that the “Learned trial Judge erred in Law and facts by his imposition of the maximum sentence of 6 Months imprisonment terms against the Appellant without an option of fine contrary to the provisions of Section 416(2) d of the Administration of Criminal Justice Act of 2015 (“ACJA”) that prescribed the mandatory guidelines on the trial Court on imposition of sentencing after criminal conviction of a first time offender as the Appellant."
The Appellant argued that the judge failed to consider his previous good conduct of not wasting judicial resources when he pleaded guilty to the charge. He also claimed that he had cooperated with the EFCC's investigation by attending their first invitation.
The appeal, therefore, seeks an “order setting aside the 6 months maximum imprisonment sentence imposed on the Appellant and in its place imposition of a fine in the sum of N5 0, 0 0 0 ( F I f y Thousand Naira) on each of the counts against the appellant”.
