The Court of Appeal in Abuja has set aside the judgment of an Abuja High Court which declared Jerry Gana as the presidential candidate of the Social Democratic Party. According to Punch, the court in a unanimous decision restored a former Governor of Cross Rivers State, Donald Duke, as the authentic presidential candidate of the party.

Duke had polled 812 votes to defeat Gana who garnered 611 votes at the party's presidential primary. Following the outcome of the exercise, the party then forwarded Duke’s name to INEC as its flag bearer.


However, Gana approached the Court claiming Duke’s emergence contravened the constitution which provides that the National Chairman of the party could not come from the same zone with the presidential aspirant.
