The Court of Appeal has reserved its judgement indefinitely in a suit filed by Senator Aishatu Dahiru Binani of the All Progressive Congress, APC over the crisis that lead to the nullification of the Adamawa APC Gubernatorial primaries. Justice Abdulaziz Anka of the Federal High Court in Yola had some two months back nullifies the candidacy of Senator Binani of the APC through his ruling that there was overvoting in the process in a case filed by her opponent, Nuhu Ribadu who came second in the primaries.
The Federal High Court had through that judgement ordered that Binani should stop parading herself as the APC Gubernatorial flag bearer in the state saying that her party does not have a candidate for 2023 in Adamawa state.
Comprised in the panel of the appeal court were; Justices Teni Yusuf Hassan, M.O Bolaji and James Abundaga but have collectively reserved judgement in the appeal after adopting briefs from counsel to Binani, Ribadu, APC and INEC.
The lead counsel to Senator Binani, Chief Akin Olujimi (SAN), who led six other SANs and 12 lawyers prayed to the appeal court to nullify the decision of the trial court and determine all pre-election matters to declare his client as the duly elected candidate for the APC in Adamawa state.
However, counsel to Ribadu, I.K. Bawa (SAN), who also appeared alongside S.T Ologunorisa (SAN) kicked while demanding the court to order a fresh election, insisting the lower court erred in law having declined to allow for a fresh election even after establishing a case of over voting as against the law.
Meanwhile, supporters of both parties are anxiously waiting for the court decision before they run out of time to celebrate their candidate.
