Just In: Court Declares Sanusi’s Banishment As Unlawful

A Federal High Court in Abuja has on Tuesday declared the banishment of the deposed Emir of Kano, Sanusi Lamido Sanusi to Awe community in Nasarawa State as illegal, unlawful and unconstitutional. Delivering the judgement, Justice Anwuli Chikere held that the banishment was a gross violation of Sanusi’s fundamental human rights, as the deposed Emir was moved out of Kano to Abuja and later to Awe against his wish.


Justice Chikere said the movement of the deposed Emir without valid court order was a violation of his rights and unconstitutional as well as a breach of his personal liberty.


She awarded N10 million compensation to Sanusi against the Kano State Government, the Nigeria Police, and the Department of State Service (DSS), and orderd the respondents to tender a public apology to him on two national dailies.


Justice Chikere noted that the Kano State Emirate Council Law relied on in the banishment of Sanusi was in conflict with the Nigerian constitution, which is supreme, hence, any law inconsistent with it is deemed null and void.
