The Appellate court has cleared the air over controversies surrounding the November 17 judgment delivered on the Kano Governorship Election, as the New Nigeria Peoples Party (NNPP) filed its notice of appeal before the Supreme Court to challenge the decision of sacking Governor Abba Yusuf while declaring Dr. Nasiru Gawuna, of the All Progressives Congress (APC) the duly elected governor of Kano State.
On Tuesday, 21st Nov 2023, there was Confusion, when the certified true copy (CTC) of the court judgment surfaced days after the judgment had been delivered. The conclusions of the CTC contradict the initial conclusions, however, the Chief Registrar of the Court of Appeal, Umar Bangari, disclosed that what happened in the judgment body was a typo error that did not in any way invalidate or change the findings and conclusion of the court. He further assured that the error would be rectified once parties in the matter file formal application to that effect.
Bangari continued by citing Order 23 Rule 4 of the Court of Appeal Handbook which empowered the court to correct any clerical error once detected by the court or any of the parties in the matter.
Meanwhile, NNPP has issued a notice of appeal to the Supreme Court over the outcome of the appellate court's decision to sack its governorship candidate from office.
According to the party, it is challenging “the entire judgment of the Court of Appeal save and except the conclusion and orders at page 67 of the duly Certified True Copy, CTC including the order as to cost favorable to the appellant.”
Listed as respondents in the notice of appeal are Governor Abba Yusuf, the APC, and the Independent National Electoral Commission (INEC).
